Privacy do's and don'ts

Do

  • Provide a clearly worded privacy statement.

  • Make the privacy statement accessible form every page.

  • Ask customers to opt-in to mailing lists.

  • Give customers the option to have you share information with marketing partners or to send them promotions.

  • Assume customers do not want to opt-in to a list unless they explicitly say so by marking a box or similar.

  • Get legal advice on your privacy statement.

  • Make sure all sub-contractors are aware of your privacy policy and their obligations to keep customer information confidential.

Don't

  • Include passive opt-in options on forms (where the customer is automatically opted-in unless they remove a check mark, etc).

  • Assume a newsletter registration is the same as the customer providing permission to sell their personal information.
